WHY CIVIL LITIGATION?
Typically it is believed that justice for trafficking comes solely from criminal prosecution of the trafficker. However, very often, the manner in which someone is trafficked involves a person or third-party entity that can be held civilly liable/responsible for the same criminal offense.
Criminal prosecution ensures public safety and punishes the wrong doer for violating state or federal law. Civil prosecution involves holding the person or entity morally and financially responsible to the SURVIVOR and deters them from permitting or engaging in similar activity in the future. Civil prosecution helps the survivor gain the financial means to start recovering and healing. With the proper compensation, it can help cover the cost of counseling, medical treatments, and other personal damages that may have occurred. The difference is clear, civil prosecution is ALL ABOUT THE SURVIVOR and protecting future potential victims.
